Parakeet Acceptable Use Policy Clients

Effective Date: March 28, 2024

We aim for our services to be used safely and responsibly. This Acceptable Use Policy (“AUP”) identifies activities that are prohibited when using Parakeet’s Services (as defined in our Terms of Service and Master Services Agreement). When you access or otherwise use our Services, you automatically agree to adhere to all of our policies, including this AUP.

1.  Scope

This Acceptable Use Policy (“AUP”) applies to the use by any individual or organization (collectively, “Users”) of all Services provided by Parakeet, and is incorporated by reference into our Terms of Service.

2.  Prohibited Uses

Any access to or other use of our Services must comply with all applicable laws and regulations, and may not promote, facilitate or encourage illegal or otherwise inappropriate activities, or the dissemination of any illegal or otherwise inappropriate materials, including, but not limited to, the following:

2.1 Prohibited Materials. Users may not, and may not allow any third party to use our Services to display, store, process or transmit, or permit the use of our Services to display, store, process or transmit:

i. Material that infringes or misappropriates a third party’s intellectual property (“IP”) or other proprietary rights, such as rights of publicity and privacy;

ii. Hate-related or violent material, and/or material advocating discrimination against individuals or groups;

iii. Obscene, excessively profane material or otherwise objectionable material;

iv. Material advocating or advancing criminal hacking, cracking, or phishing;

v. Material related to illegal drugs or paraphernalia;

vi. Malicious code, such as viruses, worms, time bombs, Trojan horses and other harmful or malicious files, scripts, agents or programs;

vii. Material that violates, encourages or furthers conduct that would violate any applicable laws, including any criminal laws, or any third-party rights, including publicity and privacy rights;

viii.  Unsolicited commercial email (spam);

vii.   Material that may be harmful to minors, or otherwise exploit or harm children;

ix.   Communications that impersonate Parakeet or another person or entity;

x. Material related to distributing illegal substances, goods, or services, including weapons, promoting suicide or self-harm, or  injuring others or destroying property;

3. Violations

Any violation of this AUP, including indirectly through the solicitation or facilitation of third parties, will be considered a material breach of the Master Service Agreement and/or any other agreement governing your use of our Services (e.g., Terms of Service, etc.). 

Parakeet reserves the right to suspend or terminate your access and/or use of Parakeet’s Services as a result of any violation of this AUP.

4. Compliance

Parakeet may monitor its Services for compliance by Users. Any failure or delay by Parakeet to identify a violation or to enforce any provision of this AUP will not create grounds for liability against Parakeet. 

5. Updates and Changes

Because generative artificial intelligence is a novel technology, we are always working to make our Service safer and more useful, by refusing harmful instructions and disallowing the production of harmful content. As a result, our policies, including this AUP, may be updated or changed over time. We reserve the right to make any updates and/or changes with or without notice.
